Terms of Service

1. Acceptance of Terms

By accessing and using AccessiSight ("the Service", "the Platform"), you accept and agree to be bound by these Terms of Service. The Service is operated by TR Futuretech LLP, Noida, Uttar Pradesh, India ("we", "us", "our"). If you do not agree, do not use the Service.

2. Description of Service

AccessiSight provides automated web accessibility scanning, reporting, educational resources, and developer tools to help organisations identify and address digital accessibility barriers. The Service generates reports that map findings to standards including WCAG 2.2, Section 508, EN 301 549, and related frameworks.

3. Not Legal Advice: Audit Tool Only

AccessiSight is an accessibility auditing and educational tool, not a provider of legal advice. Scan results, reports, VPAT outputs, resource guides, and all other content produced by the Service are for informational purposes only and do not constitute legal advice, a legal opinion, or a guarantee of legal compliance.

No warranty of legal compliance is made. Accessibility laws (including the ADA, Section 508, the EAA, EN 301 549, AODA, and equivalents in other jurisdictions) are complex, jurisdiction-specific, and subject to ongoing legislative and judicial interpretation. A passing scan result, a generated VPAT, or information provided in our resource guides does not:

  • Guarantee that your website or application is legally compliant;
  • Create an attorney-client relationship;
  • Constitute a legal opinion or professional legal advice;
  • Protect you from litigation or regulatory enforcement; or
  • certify conformance with any accessibility standard beyond what the automated scan rules can objectively verify.

You should consult a qualified attorney for legal advice specific to your organisation and jurisdiction. Automated tools, including this Service, detect approximately 30–40% of WCAG issues; manual review, user testing, and expert audit are required for comprehensive compliance assessment.

4. Accessibility Standards Covered (Educational Reference)

The Service provides guidance on the following laws and standards. This list is for educational reference only; your legal obligations depend on your jurisdiction, organisation type, and product category:

  • ADA Title III (USA): Americans with Disabilities Act; covers places of public accommodation (businesses open to the public). Sets no technical standard for websites, and courts differ on how it applies to them
  • ADA Title II (USA): Covers state and local government; the DOJ's 2024 rule requires WCAG 2.1 AA
  • Section 508 (USA): Rehabilitation Act; covers the ICT that federal agencies develop, buy or use; WCAG 2.0 AA baseline
  • CVAA (USA): 21st Century Communications and Video Accessibility Act
  • European Accessibility Act / EU Directive 2019/882 (EU): Applies since June 28, 2025; EN 301 549 is the reference standard for ICT
  • EN 301 549 (EU/EEA): European ICT accessibility standard; clause 9 corresponds to WCAG 2.1 AA for web
  • Web Accessibility Directive 2016/2102 (EU Public Sector): Public sector bodies must meet EN 301 549
  • Equality Act 2010 (UK): Reasonable adjustments duty for service providers
  • AODA (Ontario, Canada): Accessibility for Ontarians with Disabilities Act; WCAG 2.0 AA for the public sector and organisations with 50+ employees
  • DDA 1992 (Australia): Disability Discrimination Act; the Australian Human Rights Commission's 2025 guidelines recommend WCAG 2.2 AA
  • RPwD Act 2016 (India): Rights of Persons with Disabilities Act; Indian government websites follow GIGW 3.0 (WCAG 2.1 AA)
  • WCAG 2.2 (W3C Recommendation): Web Content Accessibility Guidelines, the technical reference most of the above build on

5. Accounts and Eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account or buy anything on the Service. If you use the Service for an organisation, you confirm you are authorised to accept these Terms for it. You are responsible for keeping your login credentials secure and for activity under your account.

6. User Conduct

You agree not to use the Service to:

  • Scan websites that you do not own or do not have explicit permission to scan;
  • Overload, disrupt, or interfere with our servers or the servers of third-party websites;
  • Transmit malware, viruses, or any code designed to harm systems;
  • Misrepresent scan results, generated VPATs, or conformance reports to government agencies, customers, or courts.

7. Payments, Subscriptions and Refunds

Prices are shown on our pricing page before you pay and may differ by region. Credit packs are one-time purchases. Pro Monthly and Team plans are subscriptions that renew automatically each month and are charged to your payment method until you cancel. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current paid period. We will give you advance notice of any price change to a subscription, and it will apply from your next renewal. Refunds are handled under our Refund & Cancellation Policy. Payments are processed by our payment providers; we never receive your full card number.

8. Your Content and Scan Data

You keep all rights in the websites, documents and other content you submit, and in the reports generated for you. You give us permission to fetch, store and analyse that content only to provide the Service to you (for example, to show you results, generate reports and keep your scan history), as described in our Privacy Policy. You are responsible for having the right to submit it, including any login details for authenticated scans.

Copyright complaints

Only submit websites and documents you have the right to have scanned. Reports can contain screenshots and extracts of the pages or files that were scanned. If you believe content stored or shown by the Service infringes your copyright, email accessisight@gmail.com with the subject "Copyright notice" and include: (a) your physical or electronic signature; (b) the copyrighted work you say is infringed; (c) the material you want removed and where it appears in the Service (for example the report link); (d) your name, address, telephone number and email; (e) a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; and (f) a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner. We will remove or disable access to material that a valid notice identifies, tell the user who submitted it, and consider a counter-notice from that user. We may close the accounts of users who repeatedly infringe.

9. Third-Party Services and Your AI Keys

Optional AI features only run if you add your own API key for an AI provider (such as Anthropic, OpenAI or Google). Requests made with your key are sent to that provider and are subject to its terms and to your agreement with it, and any charges are billed to you by that provider. The same applies to integrations you connect, such as GitHub or Jira. We are not responsible for third-party services.

10. VPAT / ACR Outputs

VPATs and Accessibility Conformance Reports generated by the Service are based solely on automated scan results. They are not a complete accessibility audit and must not be submitted to government agencies, enterprise clients, or courts without independent expert review and validation. False or misleading conformance claims in VPATs submitted to US federal agencies may constitute a violation of the False Claims Act (31 U.S.C. § 3729). You bear sole responsibility for the accuracy and legality of any documents derived from Service outputs.

11. Disclaimer of Warranties

To the extent permitted by law, the Service is provided on an "as is" and "as available" basis, and we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that scan results will detect every accessibility barrier.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, revenue or data, arising from your use of the Service, including from reliance on scan results, VPAT outputs, or resource guides, regulatory fines or penalties, litigation costs, or third-party claims of accessibility discrimination. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence, and nothing affects rights you have as a consumer under the mandatory laws of the country where you live.

13. Indemnification

You agree to indemnify and hold us harmless from any third-party claim, demand, loss, or damages (including reasonable legal fees) arising from your violation of these Terms or your misrepresentation of scan results or generated reports.

14. Suspension and Termination

You can stop using the Service at any time and ask us to delete your account (see our Privacy Policy). We may suspend or close an account that breaches these Terms (for example, by scanning sites without permission or abusing free credits), with notice where reasonably possible. Sections 3, 10, 11, 12 and 13 continue to apply after termination.

15. Governing Law

These Terms are governed by the laws of India. Subject to the next sentence, the courts at Noida (Gautam Buddh Nagar), Uttar Pradesh, India have exclusive jurisdiction over disputes arising from them. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live and may bring a claim there.

16. Changes to Terms

We may update these Terms. For material changes, we will update the date above and give account holders reasonable advance notice (for example, by email or in the app) before the changes take effect. If you continue to use the Service after they take effect, the updated Terms apply; if you don't agree, you can stop using the Service and cancel any subscription.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and the Refund & Cancellation Policy, are the entire agreement between you and us about the Service.
